In 1995, I was convicted of first degree murder for actions taken while preventing an attack against a 63 yr. old crippled man. In defense of the original victim, I fought the the assailant. Some hours later, I was arrested for assault, and, while waiting for bond to be set, the original assailant died in the hospital. I was subsequently charged and indicted on first degree murder, to wit. "intentionally and knowingly causing the death of an individual by kicking him in the head with foot". At trial, the autopsy report concluded there were no injuries consistent with the assault alleged in the indictment and that the cause of death was hypothermia and cardiac arrest. The court refused to allow the jury to consider a lesser offense. I'm seeking friendship, correspondence and any legal assistance. I need help getting my case back in court for reconsideration of a lesser offense. I cannot afford hired legal help. My legal knowledge and access to research material is very limited.
